Troy Marriage License Filing

Marriage licenses in Troy are filed through Rensselaer County. Troy is the county seat and the largest city in the county. The Troy City Clerk issues marriage licenses from the downtown City Hall building. Under DRL Section 13, any couple can get a marriage license from any town or city clerk in New York, regardless of where they live or plan to marry.

Rensselaer County sits on the east bank of the Hudson River, directly across from Albany. Besides Troy, the county includes smaller towns and villages where local clerks also issue marriage licenses. But Troy's City Hall is the most accessible option for many people in the area. The city clerk's office manages all vital records for the City of Troy, not just marriage licenses. Birth certificates, death records, and other official documents all go through the same office.

Note: Town clerks in other parts of Rensselaer County can also issue marriage licenses if the Troy office is more out of your way.

Both partners must appear together at the Troy City Clerk's office. City Hall is at 433 River Street, Troy, NY 12180. You need to bring valid photo identification. A driver's license, passport, or state-issued ID card all work. A certified birth certificate with raised seal showing your parents' names is required too. Keep your Social Security number ready because the clerk will ask for it during the application.

Previous marriages need documentation. Bring a final divorce decree or a death certificate for a former spouse. The clerk will not process a new license until all prior marriages are accounted for. The application fee is $40. Pay it when you apply. You walk out with the license the same day. Then a mandatory 24-hour waiting period begins per DRL Section 13-b. Your ceremony cannot happen until at least the next day. The license is valid for 60 days after issuance and can be used anywhere in New York State. Active duty military personnel receive a 180-day validity window instead.

After Your Troy Wedding

The officiant must send the signed marriage license back to the Troy City Clerk within five days of the wedding. It does not matter where the ceremony took place. Both spouses, the officiant, and at least one witness all need to sign the license during the ceremony. Under DRL Section 14, the clerk fills out the form and hands it to the couple, who then pass it to their officiant before the wedding.

Many types of people can officiate a wedding in New York. Judges at any court level are authorized. Mayors can perform ceremonies. Ordained clergy members of any faith qualify under Section 11 of the Domestic Relations Law. You can also petition the governor's office to appoint a friend or relative as a one-day marriage officer. That option takes some lead time, so plan ahead if you go that route. Once the Troy clerk gets the signed license back, it goes on file with the state. Expect a Certificate of Marriage Registration in the mail within about 20 days.

Troy Marriage Record Copies

Certified copies of a Troy marriage license cost $10 from the city clerk. You can request them in person or by mail. In person, bring a photo ID. By mail, send a notarized letter with both spouses' names, the date of the marriage, and a check or money order for $10 payable to the Troy City Clerk. Mail it to City Hall, 433 River Street, Troy, NY 12180.

The New York State Department of Health is another option for certified copies at $30 each. State processing takes 10 to 12 weeks. Priority handling costs an extra $15. VitalChek provides rush delivery for an additional fee. The NYS Department of Health genealogy section handles marriage records that are more than 50 years old when both spouses are deceased. This is especially useful for people doing family history research in the Capital District region.

Note: The Rensselaer County Clerk handles property records and court filings but does not issue marriage licenses.
