Applying for a Dutchess County Marriage License
Both applicants must appear in person at the clerk's office. A representative cannot apply on your behalf, even with power of attorney. Notarized affidavits signed ahead of time cannot replace your appearance in the office. The fee is $40.00 and is paid when you apply.
If both parties are 18 or older, no parental consent is needed. Under New York law, minors under 18 cannot get a marriage license at all. You need to bring information about any past marriages. This includes whether former spouses are alive, and if you are divorced, when and where the divorce was granted. A certified copy of each divorce decree is required. The clerk in Beekman accepts only original or certified copies with a raised seal, and all documents must be in English or accompanied by a certified translation.
The license comes out right away. But the ceremony cannot happen until 24 hours after the exact time the license was issued, per DRL Section 13-b. After that waiting period, the license is good for 60 days. Active military members can get up to 180 days if they show proof at the time of application.

After Getting Your Dutchess County Marriage License
Your name does not change just because you get married. A person's surname stays the same unless they take steps to change it. On the marriage license application, one or both parties can enter a new surname. The options include taking the other spouse's last name, using a former surname of either spouse, combining parts of both names into one, or using a hyphenated version. The change takes effect once the ceremony is complete.
Under Section 11 of the Domestic Relations Law, a marriage ceremony in Dutchess County can be performed by judges, town justices, mayors, and ordained clergy. The officiant does not need to live in New York. There is no set script for the ceremony. The couple must state, in front of the officiant and at least one witness, that they take each other as spouses. After the ceremony, the officiant signs the license and sends it back to the issuing clerk within five days.
The clerk then sends a Certificate of Marriage Registration to the couple within about 15 days. This is your proof that the marriage is on file. If it does not show up within four weeks, contact the clerk.
