Essex County Marriage License Offices

Marriage licenses in Essex County are issued by town clerks, not the county clerk. The Town of Essex clerk is one office that handles applications. You do not need to apply in the town where you live. Any town clerk in New York State can issue a license, so you can choose any Essex County office that works for you.

The application must be signed by both people in the presence of the clerk. No blood tests are needed. If both applicants are 18 or older, no parental consent is required. The Town of Essex requests that you schedule an appointment with their clerk to get a marriage license. The fee is $40.00 and can be paid by cash, check, money order, MasterCard, or Visa.

The Essex County Clerk's office is responsible for court records and land records. Under the New York State constitution, the county clerk is considered the principal office of county government. Each applicant must provide proof of age and proof of identity when applying for a marriage license in Essex County. These are two separate requirements, so you need one document from each list.

For proof of age, the Town of Essex accepts a birth certificate, baptismal record, naturalization record, or census record. For proof of identity, they accept a driver's license, state-issued non-driver photo ID, passport, U.S. Military photo ID, employment photo ID, or immigration record. All documents must be current originals or certified copies with a raised seal. Everything must be in English. If a document is in another language, you need a certified translation.

If either person has been married before, they must bring certified proof of how each prior marriage ended. This means a divorce decree or death certificate for every previous marriage, not just the last one. Under DRL Section 13, the clerk must verify all this before issuing the license.

Note: The license is issued right away but cannot be used for 24 hours, and it stays valid for 60 days after that waiting period per DRL Section 13-b.

Marriage Ceremonies in Essex County

Under Section 11 of the Domestic Relations Law, a valid marriage ceremony in Essex County can be performed by a town justice, a judge from most New York courts, ordained clergy, or a minister chosen by a spiritual group. The officiant does not have to live in New York. There is no set script or form for the ceremony. The couple must state in front of the officiant and at least one witness that they take each other as spouses.

Essex County is a popular spot for Adirondack weddings. Many couples pick lakeside or mountain settings. The legal rules are the same no matter where you hold the ceremony. Just make sure the officiant is authorized under Section 11 and that your license is valid on the day of the wedding.

Surname options are listed on the marriage license application. Your last name does not change automatically when you marry. One or both parties can choose to take the other spouse's name, use a former surname, combine both names into one, or use a hyphenated version. The name change takes effect after the ceremony is complete.

Essex County Marriage Records

After the wedding, the officiant fills out the license and sends it back to the issuing clerk. The clerk mails a Certificate of Marriage Registration to the couple within about 15 days. If you do not get it within four weeks, call the clerk. Certified copies cost $10 from the town clerk who issued the license.

For older records, the genealogy section provides uncertified copies of marriage certificates on file for at least 50 years if both spouses are deceased. The search fee starts at $22.
