Marriage licenses in Babylon are filed through Suffolk County. The Babylon Town Clerk is the office that issues them, but other town clerks in Suffolk County can do the same thing. You do not have to live in Babylon or Suffolk County to apply. Under DRL Section 13, any couple can get a marriage license from any town or city clerk in New York State. It does not matter where the ceremony will take place.
The Suffolk County Clerk's office keeps birth, marriage, and death records from 1908 to 1935 on file. For records after 1935, you need to contact the town clerk where the license was purchased. That means the Babylon Town Clerk holds most modern marriage records for the town. The Suffolk County Historical Society in Riverhead also has older records that may be useful for genealogy work.
Babylon was part of the Town of Huntington until 1872, so early marriage records may be filed under Huntington. If you need a record from before that date, check with the Huntington Town Clerk as well.
How to Get a Marriage License in Babylon
Both partners must show up together at the Babylon Town Clerk's office. The office is at 200 East Sunrise Highway, Lindenhurst, NY 11757. You can reach the clerk by phone at (631) 957-3005. Bring a valid photo ID like a driver's license, passport, or state-issued non-driver ID. You also need a certified birth certificate that shows your parents' names. Have your Social Security number ready.
If you were married before, bring your final divorce decree or a death certificate for your former spouse. All prior marriages must be fully ended before you can apply for a new license. The fee is $40. Credit and debit cards may carry a small convenience fee on top of that. Once the clerk processes your form, you get the license that same day. A 24-hour waiting period then kicks in per DRL Section 13-b. You cannot get married the same day you pick up the license. Your Babylon marriage license stays valid for 60 days and works anywhere in New York State. Active military members get 180 days instead.

After Your Babylon Wedding Ceremony
After the wedding, the officiant must return the signed marriage license to the Babylon Town Clerk's office within five days. This applies whether the ceremony was in Babylon or somewhere else in the state. The officiant, both spouses, and at least one witness all sign the license at the end of the ceremony. Per DRL Section 14, the clerk fills out the license form and hands it to the couple, who then give it to their officiant for the wedding day.
Under Section 11 of the Domestic Relations Law, many types of people can perform your ceremony. Judges, mayors, ordained clergy, and appointed one-day marriage officers all qualify. The Town of Huntington, which is next door to Babylon in Suffolk County, issues one-day marriage officiant licenses through its town clerk. Babylon may offer the same service. Once the officiant sends the signed license back to the Babylon Town Clerk, the clerk files it with the state. You should get a Certificate of Marriage Registration in the mail within about 20 days.
Babylon Marriage License Copies
You can get a certified copy of your Babylon marriage license from the town clerk who issued it. The fee is $10 per copy. Bring a photo ID and pay in person, or mail a request with a notarized letter that includes the names of both spouses and the date of the marriage. Include a check or money order for $10 payable to the Babylon Town Clerk.
The New York State Department of Health also provides certified copies for $30 each. Processing takes 10 to 12 weeks through regular mail. Priority handling adds $15 to the total.
